Phoslume Lighting operates as an independent supplier, reseller, channel partner and architectural-lighting service facilitator for products manufactured, imported, assembled or marketed by third-party lighting brands.

Phoslume may provide an additional service layer that includes product guidance, fixture selection, lighting specification, Bill of Quantities preparation, procurement coordination, supply coordination, installation guidance, site support, aiming and commissioning assistance where specifically included in the applicable quotation or order.

Phoslume Lighting is not a separate legal entity from Lusso Cassano Private Limited. All orders, invoices, payments and contractual obligations entered into through Phoslume Lighting are with Lusso Cassano Private Limited unless expressly stated otherwise in writing.

Phoslume will describe itself as an “authorised dealer”, “authorised reseller” or “authorised channel partner” of a particular brand only where such authorisation has been formally provided by that brand.

Application of These Terms

These Terms and Conditions govern:

  1. Your access to and use of the Phoslume Lighting website, including phoslumelighting.com.
  2. Product enquiries and quotation requests.
  3. Orders placed through the Website, Shopify checkout, email, telephone, WhatsApp or other approved communication channels.
  4. Retail and direct-to-consumer purchases.
  5. Orders placed by architects, interior designers, contractors, consultants, developers and trade customers.
  6. Lighting-design, specification, coordination, consultation, aiming and commissioning services where included in writing.
  7. The supply of luminaires, downlights, spotlights, LED strips, aluminium profiles, drivers, power supplies, tracks, controls and related lighting accessories.

By accessing the Website, placing an order, making payment, accepting a quotation or using our products or services, you agree to these Terms.

Nothing in these Terms removes or restricts a legal right that cannot lawfully be excluded.

Definitions

For these Terms:

Acceptance and Electronic Contracting

You accept these Terms when you:

  • Place an order through the Website.
  • Accept a quotation or order confirmation.
  • Make full or partial payment.
  • Confirm approval through email or WhatsApp.
  • Instruct Phoslume to commence procurement or services.
  • Accept delivery of a Product.
  • Use a Phoslume service.

Your electronic acceptance, payment confirmation, email approval or WhatsApp approval may constitute valid acceptance of the order and these Terms.

Where an individual acts on behalf of a company, firm, practice, client or project, that individual confirms that they have the authority to approve the order and bind the relevant party.

Eligibility

You must be at least eighteen years old and legally capable of entering into a binding contract to place an order.

You must provide complete, current and accurate information during checkout, enquiry, quotation and invoicing.

Phoslume may refuse or suspend an order where:

  • The information provided appears incorrect.
  • Payment appears unauthorised or fraudulent.
  • The purchaser lacks authority to place the order.
  • The transaction appears unlawful.
  • The requested application presents a safety or compatibility concern.

Contract Documents and Order of Precedence

The contract between Phoslume and the Customer may include:

  1. A separately signed agreement.
  2. An accepted project quotation.
  3. A final order confirmation.
  4. The tax invoice.
  5. Product-specific specifications.
  6. Manufacturer warranty conditions.
  7. The Shipping Policy.
  8. The Return and Refund Policy.
  9. These Terms and Conditions.
  10. The Privacy Policy.

Where these documents conflict, the document appearing earlier in the above list will ordinarily prevail for that transaction.

A manufacturer warranty document governs the scope of the manufacturer’s warranty but does not override Phoslume’s own commitments or the Customer’s statutory rights.

Third-Party Brands and Products

Unless expressly stated otherwise, Products supplied by Phoslume are manufactured, imported, assembled or marketed by independent third-party brands.

The relevant Product brand, manufacturer, importer or warranty provider may be identified through:

  • The Product page.
  • Product packaging.
  • The quotation.
  • The tax invoice.
  • The specification sheet.
  • The manufacturer’s catalogue.
  • The warranty card.
  • Other Product documentation.

References to brand names, logos or Product names do not imply ownership of those brands by Phoslume.

All third-party trademarks, Product names, images and technical documents remain the property of their respective owners.

Phoslume’s supply of a third-party Product does not mean that Phoslume manufactured that Product.

However, Phoslume remains responsible for:

  • Accurately representing the Product based on information reasonably available to us.
  • Supplying the Product confirmed in the final order.
  • Fulfilling our contractual supply commitments.
  • Performing our own Services with reasonable care.
  • Facilitating legitimate complaints and warranty requests.
  • Complying with obligations imposed on us under applicable law.

Product Information

Phoslume takes reasonable care to present Product information accurately.

Product information may include:

  • Product name and code.
  • Brand or manufacturer.
  • Wattage.
  • Luminous output.
  • Beam angle.
  • Colour temperature.
  • Colour Rendering Index.
  • IP rating.
  • Driver details.
  • Dimming compatibility.
  • Input voltage.
  • Fixture dimensions.
  • Cut-out dimensions.
  • Ceiling-depth requirements.
  • Finish and colour.
  • Material.
  • Country of origin.
  • Warranty period.
  • Maximum retail price.
  • Manufacturer or importer details.

Required declarations will be displayed on the Product page, packaging, invoice or accompanying documentation where applicable.

The Customer must review the final quotation, specification sheet or order confirmation before approving an order.

Where general Website information differs from the final approved quotation or Product-specific documentation, the final approved Product documentation will prevail.

Images, Finishes and Product Variations

Product photographs, videos, renders and illustrations are provided to assist identification and selection.

Actual appearance may vary because of:

  • Screen calibration.
  • Photography and lighting conditions.
  • Material and finish variations.
  • Manufacturing batches.
  • LED binning.
  • Component revisions.
  • Surrounding wall and ceiling colours.
  • Surface reflectance.
  • Viewing angle.
  • Installation conditions.

Minor variations that fall within the manufacturer’s published tolerances will not automatically constitute a defect.

Where exact colour matching, output matching or batch consistency is essential, the Customer must inform Phoslume before placing the order.

Phoslume may recommend ordering all matching Products for a room or project together to reduce potential batch variation.

Manufacturer and Component Updates

Manufacturers may revise:

  • LED chips.
  • Drivers.
  • Optics.
  • Connectors.
  • Internal components.
  • Finishes.
  • Product dimensions.
  • Product codes.
  • Packaging.
  • Performance specifications.

Phoslume will not knowingly supply a materially different Product without informing the Customer.

A technically equivalent or improved component revision may be supplied where the external form, intended application and essential performance remain materially consistent.

If a Product has been discontinued, Phoslume may propose an equivalent replacement. The Customer’s approval will be obtained before substitution where the change is material.

Lighting Guidance and Educational Content

General content on the Website concerning lighting design, lumens, lux, beam angles, glare, colour temperature, CRI, drivers, dimming, fixture spacing and room-wise recommendations is educational and indicative.

It does not constitute a project-specific guarantee or replace:

  • A professional lighting design.
  • An electrical design.
  • A structural review.
  • A site inspection.
  • An architect’s approval.
  • A qualified electrician’s assessment.
  • A lighting-control consultant’s assessment.

Lighting outcomes are influenced by:

  • Ceiling height.
  • Fixture position.
  • Beam angle.
  • Mounting and aiming.
  • Surface reflectance.
  • Wall and ceiling colours.
  • Furniture placement.
  • Natural light.
  • Driver performance.
  • Dimming compatibility.
  • Voltage quality.
  • Installation workmanship.
  • User preference.

A Product’s lumen output alone does not guarantee a particular lux level or visual effect at the project site.

Project-Specific Lighting Services

Where Phoslume is engaged for lighting guidance, specification or design support, our recommendations will be based on information supplied by the Customer and project consultants.

The Customer must provide accurate and current:

  • Architectural plans.
  • Furniture layouts.
  • Reflected ceiling plans.
  • Sections and elevations.
  • Ceiling heights.
  • Joinery drawings.
  • Electrical information.
  • Material and finish details.
  • Project location.
  • Intended use of each space.
  • Budget requirements.
  • Control and dimming requirements.

Phoslume is not responsible for an outcome affected by inaccurate, incomplete or outdated information.

Unless expressly included in writing, Phoslume’s scope does not include:

  • Structural engineering.
  • Electrical load design.
  • Circuit design.
  • Cable sizing.
  • Earthing design.
  • Automation programming.
  • Fire-safety design.
  • Emergency-lighting certification.
  • Statutory approvals.
  • Architectural coordination outside lighting.
  • Contractor supervision.
  • Installation responsibility.

Lighting Calculations and Simulations

Lux calculations, DIALux outputs, photometric studies, renders and simulations are estimates based on:

  • Manufacturer photometric files.
  • Assumed reflectance values.
  • Assumed fixture locations.
  • Provided dimensions.
  • Modelled operating conditions.

Actual site performance may differ due to installation tolerances, surface conditions, voltage, maintenance, furniture, daylight and other environmental factors.

Unless expressly guaranteed in a signed agreement, lighting calculations and visualisations do not constitute a guarantee of an exact illuminance value, beam effect or visual appearance.

Customer Approval of Specifications

Before placing or approving an order, the Customer must verify:

  • Product brand and code.
  • Quantity.
  • Wattage.
  • Lumens.
  • Beam angle.
  • CCT.
  • CRI.
  • Finish.
  • Dimensions.
  • Cut-out size.
  • Ceiling depth.
  • IP rating.
  • Driver.
  • Dimming protocol.
  • Track compatibility.
  • Control compatibility.
  • Delivery location.
  • Required delivery timeline.

Approval of the quotation, BOQ or order confirmation will be treated as confirmation that the above details have been reviewed.

Phoslume will assist with clarification but cannot accept responsibility for an approved specification subsequently changed by the Customer, architect, designer, contractor or electrician without written confirmation from Phoslume.

Prices and Taxes

All prices are stated in Indian Rupees unless expressly stated otherwise.

The Website or quotation will indicate whether the price includes or excludes:

  • GST.
  • Delivery.
  • Handling.
  • Installation.
  • Site visits.
  • Design fees.
  • Programming.
  • Commissioning.
  • Special packaging.
  • Access equipment.
  • Other project-specific costs.

The final amount shown at checkout or in the accepted quotation will govern the order.

Prices may change before order acceptance because of:

  • Manufacturer price revisions.
  • Import costs.
  • Exchange-rate changes.
  • Freight changes.
  • Tax changes.
  • Product availability.
  • Quantity changes.
  • Specification changes.
  • Customisation.
  • Project-location requirements.

Once an order has been accepted and paid, Phoslume will not alter the price for that confirmed scope unless the Customer requests a change.

Trade Pricing and Commercial Confidentiality

Trade prices, project prices, designer prices, referral arrangements and special discounts are confidential.

They apply only to:

  • The named Customer.
  • The specified project.
  • The approved quantities.
  • The stated validity period.
  • The agreed payment and delivery conditions.

Trade pricing may not be transferred, published, advertised or shared with another purchaser without Phoslume’s written consent.

Phoslume may offer different commercial structures to architects, designers, contractors, project managers and end customers.

Any referral fee, service fee, commission or commercial arrangement must be agreed separately and handled in accordance with applicable tax and invoicing requirements.

Quotations

A quotation remains valid only for the validity period stated in it.

After expiry, Phoslume may revise:

  • Pricing.
  • Availability.
  • Lead time.
  • Freight.
  • Taxes.
  • Warranty information.
  • Technical specifications.

A quotation is not an order confirmation unless expressly stated.

Phoslume is not required to reserve stock before receiving the required payment and issuing order confirmation.

Orders and Acceptance

Placing an order does not automatically mean that the order has been accepted.

An order is accepted when Phoslume:

  • Issues written order confirmation.
  • Accepts the applicable payment.
  • Confirms acceptance through an authorised communication.
  • Commences non-cancellable procurement.
  • Dispatches the Product.

Phoslume may refuse or cancel an order before dispatch where:

  • The Product is unavailable.
  • There is an obvious pricing or listing error.
  • Payment has failed.
  • Payment appears unauthorised.
  • The order cannot be delivered to the location.
  • The Product is unsuitable for the disclosed application.
  • The Customer has supplied incomplete information.
  • The transaction appears fraudulent or unlawful.

Where Phoslume cancels an accepted order for reasons not attributable to the Customer, the amount collected for the cancelled portion will be refunded.

Payment Terms

Unless expressly agreed otherwise in writing:

Payment requirement

ALL PRODUCT ORDERS REQUIRE 100% PAYMENT BEFORE PROCUREMENT CONFIRMATION OR DISPATCH.

Phoslume is not required to:

  • Reserve stock.
  • Commence special procurement.
  • Place a manufacturer order.
  • Cut or assemble Products.
  • Release Products for dispatch.

until the required payment has been received and verified.

Professional-service fees will be payable according to the applicable quotation.

Payment may be accepted through:

  • Shopify-supported payment methods.
  • Bank transfer.
  • UPI.
  • Approved payment gateways.
  • Other methods confirmed by Phoslume.

The Customer is responsible for any bank or payment charges not included in the invoice.

GST Invoices

Customers requesting a GST invoice must provide the correct:

  • Legal name.
  • Billing address.
  • GSTIN.
  • State and place of supply.
  • Purchase-order information where applicable.

This information must be provided before the invoice is issued.

Phoslume is not responsible for an incorrect invoice or unavailable input-tax treatment caused by incorrect or delayed information provided by the Customer.

Invoice amendments will be subject to applicable tax rules and accounting periods.

Custom, Special-Order and Project-Specific Products

Custom or special-order Products may include:

  • Special finishes.
  • Non-standard colours.
  • Special beam angles.
  • Special CCT options.
  • Project-specific drivers.
  • Imported-on-order Products.
  • Cut-to-length LED strips.
  • Cut aluminium profiles.
  • Assembled track systems.
  • Modified configurations.
  • Products procured specifically against an approved BOQ.

Once production, cutting, assembly, import, procurement or manufacturer ordering has commenced, such Products cannot ordinarily be cancelled or returned for a change of mind.

This restriction does not apply where the Product is defective, damaged, incorrectly supplied or materially different from the agreed specification.

Changes to Approved Orders

Requests to change an order must be made in writing.

A requested change is effective only after Phoslume confirms:

  • Technical feasibility.
  • Revised pricing.
  • Revised lead time.
  • Revised warranty implications.
  • Revised delivery conditions.

Phoslume may reject a change where:

  • Procurement has commenced.
  • The Product has been cut or assembled.
  • The manufacturer has accepted a non-cancellable order.
  • The Product has been dispatched.
  • The change creates a compatibility or safety concern.

Additional costs arising from a Customer-requested change must be paid before the revised order proceeds.

23

Cancellations

23.1 Standard stock Products

A standard stock order may be cancelled before dispatch, subject to confirmation from Phoslume.

Where no non-recoverable cost has been incurred, the amount paid for the cancelled Products will be refunded.

23.2 Custom or special-order Products

A custom or special-order Product cannot ordinarily be cancelled after procurement, cutting, assembly, import or manufacture has commenced.

Where cancellation is accepted, Phoslume may deduct documented, non-recoverable costs already incurred.

23.3 Orders already dispatched

An order cannot be cancelled after dispatch. The Customer may request a return under the applicable return conditions.

23.4 Cancellation by Phoslume

Where Phoslume cancels the order for reasons not attributable to the Customer, Phoslume will refund the amount collected for the cancelled portion without imposing a cancellation charge.

Shipping and Delivery

Delivery timelines are estimates unless expressly guaranteed in writing.

Delivery may be affected by:

  • Product availability.
  • Manufacturer lead times.
  • Customisation.
  • Import timelines.
  • Courier operations.
  • Transport restrictions.
  • Weather.
  • Government action.
  • Incorrect delivery information.
  • Site-access restrictions.
  • Force-majeure events.

Phoslume will use reasonable efforts to communicate material delays.

A delay does not automatically entitle a Customer to compensation, but statutory remedies and expressly agreed delivery commitments remain unaffected.

Delivery Address and Site Access

The Customer must provide a complete and serviceable delivery address.

The Customer must ensure:

  • Someone is available to receive the shipment.
  • The delivery vehicle can access the location.
  • Required entry permissions are available.
  • The receiving party can inspect and acknowledge delivery.
  • Safe unloading arrangements are available for large or fragile consignments.

Additional costs caused by an incorrect address, refused delivery, repeat delivery, storage, difficult access or unavailable recipient may be charged to the Customer where reasonably incurred.

Split Deliveries

Phoslume may deliver an order in separate consignments where:

  • Products have different lead times.
  • Different manufacturers are involved.
  • Part of the order is ready earlier.
  • Separate delivery reduces project delay.

A split delivery does not change the total amount payable unless additional delivery charges are agreed in advance.

Transfer of Ownership and Risk

Ownership of Products passes to the Customer only after Phoslume has received full payment.

For consumer orders, risk of accidental loss or transit damage passes upon physical delivery to the Customer or the Customer’s authorised recipient.

For trade or project orders, risk will pass according to the delivery arrangement stated in the quotation or order confirmation.

This clause does not exclude responsibility for Products damaged before delivery.

Inspection Upon Delivery

The Customer should inspect the shipment promptly after delivery.

The Customer should report:

  • Visible transit damage.
  • Tampered packaging.
  • Missing items.
  • Incorrect Products.
  • Incorrect quantities.
  • Broken Products.

preferably within forty-eight hours of delivery.

The report should include:

  • Order or invoice number.
  • Product code.
  • Description of the issue.
  • Photographs of the packaging.
  • Photographs or video of the Product.
  • Shipping label.
  • Quantity affected.

An unboxing video is recommended for faster verification but will not be treated as the only acceptable evidence.

The Product must not be installed, modified or energised after visible damage or incorrect supply has been identified.

A delayed report may make transit verification more difficult but will not remove a statutory right.

Seven-Day Return Window

A return request for an ordinary standard-stock Product may be submitted within seven calendar days from delivery, provided that the Product is:

  • Unused.
  • Uninstalled.
  • Not wired or energised.
  • Unmodified.
  • Undamaged.
  • Complete with all accessories.
  • In its original packaging.
  • In resaleable condition.
  • Accompanied by proof of purchase.

Return approval must be obtained from Phoslume before the Product is sent back.

Approval of a return request does not constitute final acceptance of the return. Final acceptance is subject to inspection after receipt.

Change-of-Mind Returns

For an approved change-of-mind return:

  • The Customer may be responsible for return-shipping costs.
  • The Customer is responsible for safe return packaging.
  • The original delivery charge may not be refundable where delivery was successfully completed.
  • Any refund may exclude payment-gateway or logistics costs actually incurred and not recoverable by Phoslume, where lawful.
  • No arbitrary deduction will be made without explanation.

The Product remains the Customer’s responsibility until received by Phoslume.

Non-Returnable Products

The following Products are not ordinarily returnable for a change of mind:

  • Custom Products.
  • Special-order Products.
  • Imported-on-order Products.
  • Cut LED strips.
  • Cut aluminium profiles.
  • Assembled track systems.
  • Modified Products.
  • Project-specific configurations.
  • Installed Products.
  • Wired or energised Products.
  • Products with damaged or missing packaging.
  • Clearance or final-sale Products identified before purchase.
  • Products damaged through improper handling or storage.

These exclusions do not apply where the Product is defective, damaged before delivery, incorrectly supplied or materially misdescribed.

Defective, Damaged or Incorrect Products

Where a Product is:

  • Defective.
  • Damaged before delivery.
  • Incorrectly supplied.
  • Missing from the shipment.
  • Materially different from the confirmed specification.
  • Not of the characteristics represented or agreed.

the Customer should contact Phoslume promptly.

Depending on the circumstances, Phoslume may offer:

  • Inspection.
  • Technical assistance.
  • Repair.
  • Replacement.
  • Collection.
  • Credit note.
  • Refund.
  • Manufacturer-warranty facilitation.

For a confirmed defective, damaged or incorrect Product, Phoslume will not require the Customer to bear return-shipping costs unless the claim is later found to be unsupported or caused by Customer handling or installation.

Refund Processing

Approved refunds will ordinarily be made to the original payment method.

Refund processing may begin after:

  • The returned Product is received.
  • The Product is inspected.
  • The return is approved.
  • Bank or payment-gateway information is verified.

Bank and payment-gateway processing times are outside Phoslume’s direct control.

Where only part of an order is returned, only the approved returned portion will be refunded.

Phoslume will not unreasonably delay an accepted refund.

Installation Requirements

Architectural-lighting Products must be installed by an appropriately qualified electrician or contractor.

Installation must comply with:

  • Product instructions.
  • Manufacturer instructions.
  • Approved drawings.
  • Correct wiring and polarity.
  • Appropriate earthing.
  • Appropriate surge protection.
  • Required voltage.
  • Thermal clearances.
  • Driver requirements.
  • Dimming requirements.
  • IP-rating limitations.
  • Applicable electrical requirements.

Products should not be installed solely based on catalogue drawings where actual Product verification is possible.

The actual Product and final dimensions must be checked before cutting ceilings, joinery, walls or floors.

Ceiling Cut-Outs and Product Dimensions

The Customer, architect, designer and installer must verify:

  • Cut-out dimensions.
  • Fixture dimensions.
  • Recess depth.
  • Driver clearance.
  • Ventilation.
  • Access requirements.

before commencing ceiling or joinery work.

Phoslume is not responsible for rectification of incorrect openings, ceiling damage or civil work performed before the actual Product and current specification have been verified.

Where Phoslume supplies a cut-out dimension, that dimension must still be checked against the delivered Product before final installation.

Drivers, Dimmers and Controls

A dimmable fixture is not automatically compatible with every dimmer.

Compatibility depends on:

  • Driver model.
  • Dimming protocol.
  • Dimmer type.
  • Minimum and maximum load.
  • Circuit configuration.
  • Control system.
  • Wiring.
  • Number of fixtures.
  • Electrical conditions.

Protocols may include phase-cut, Triac, 0–10V, DALI, PWM, DMX or other systems.

The complete combination must be verified before installation.

Phoslume is not responsible for flicker, noise, limited dimming range or malfunction caused by an unapproved driver, dimmer or control-system combination.

LED Strips, Profiles and Power Supplies

LED strips must be installed using appropriate:

  • Drivers or power supplies.
  • Voltage.
  • Wattage allowance.
  • Cable sizing.
  • Wiring lengths.
  • Aluminium profiles where required.
  • Heat dissipation.
  • Diffusers.
  • IP protection.
  • Access for maintenance.

Voltage drop, thermal conditions and run length must be considered before installation.

Cut LED strips and profiles are custom Products and cannot ordinarily be returned for a change of mind.

Phoslume is not responsible for strip failure caused by:

  • Incorrect cutting.
  • Poor soldering.
  • Reverse polarity.

  • Excessive run length.
  • Lack of heat dissipation.
  • Incorrect sealing.
  • Water ingress.
  • Unapproved installation methods.

Wet Areas and IP Ratings

Products must be used only in environments appropriate to their IP rating and manufacturer instructions.

The Customer and installer must consider:

  • Direct water exposure.
  • Steam.
  • Condensation.
  • Splash zones.
  • Outdoor exposure.
  • Drainage.
  • Sealing.
  • Driver location.
  • Cable-entry protection.

An IP-rated Product may still fail where it is incorrectly installed, opened, modified or inadequately sealed.

Dry-location Products must not be installed in wet or exposed areas merely because the surrounding ceiling or enclosure appears protected.

Installation by Independent Contractors

Unless installation is expressly included in Phoslume’s quotation, installation is performed by contractors independently appointed by the Customer, architect, designer or project team.

An independent electrician or contractor does not become Phoslume’s employee, agent or representative merely because Phoslume:

  • Supplies installation notes.
  • Answers technical questions.
  • Coordinates delivery.
  • Communicates with the installer.
  • Visits the site.

Phoslume does not assume responsibility for independent workmanship unless installation or supervision responsibility has been expressly accepted in writing.

Manufacturer Warranty

40.1 Nature of the warranty

Unless Phoslume expressly provides a separate written warranty, the Product warranty is the warranty offered by the relevant:

  • Manufacturer.
  • Importer.
  • Brand owner.
  • Distributor.
  • Authorised warranty provider.

The applicable warranty period may be stated on:

  • The Product page.
  • The quotation.
  • The invoice.
  • The specification sheet.
  • The packaging.
  • The warranty card.
  • Manufacturer documentation.

No general warranty period should be assumed for all Products.

Different brands, drivers, LED strips, fixtures and controls may carry different warranty periods and conditions.

40.2 No implied Phoslume manufacturing warranty

Phoslume’s supply of a Product, assistance with selection or facilitation of a warranty claim does not mean that Phoslume manufactured the Product.

Unless expressly stated in writing, Phoslume does not create an independent Product warranty beyond:

  • The warranty communicated for the Product.
  • Phoslume’s own contractual commitments.
  • Responsibilities imposed by applicable law.

40.3 First point of contact

Customers may contact Phoslume for assistance with a suspected Product defect.

Phoslume will use reasonable efforts to:

  • Record the complaint.
  • Review available evidence.
  • Conduct a preliminary assessment.
  • Contact the relevant manufacturer or supplier.
  • Coordinate inspection where required.
  • Facilitate claim processing.
  • Communicate the available remedy.

40.4 Warranty documentation

A warranty claim may require:

  • Proof of purchase.
  • Invoice number.

  • Photographs or videos.
  • Installation date.
  • Installer details.
  • Driver details.
  • Dimmer details.
  • Electrical test information.
  • Site inspection.
  • Return of the affected Product.

The absence of original packaging will not automatically invalidate a genuine manufacturing-defect claim, although safe packaging may be required for return transport.

40.5 Assessment and remedy

Warranty claims will be assessed according to:

  • The manufacturer’s warranty.
  • Product condition.
  • Installation conditions.
  • Reported failure.
  • Available evidence.
  • Applicable law.

The available remedy may include:

  • Repair.
  • Component replacement.
  • Complete Product replacement.
  • Equivalent replacement.
  • Credit note.
  • Refund where required or approved.

Where the original model has been discontinued, the replacement may differ in dimensions, finish, output, component or appearance.

40.6 Replacement warranty period

A repaired or replaced Product will ordinarily remain covered for the unexpired portion of the original warranty unless:

  • The manufacturer provides a new warranty period.
  • The applicable warranty states otherwise.
  • Applicable law requires otherwise.

Subject to the applicable manufacturer warranty and the Customer’s statutory rights, a warranty may exclude damage caused by:

  • Incorrect installation.
  • Incorrect wiring.
  • Incorrect polarity.
  • Inadequate earthing.
  • Electrical surge.
  • Voltage fluctuation.
  • Unstable power.
  • Incompatible drivers.
  • Incompatible dimmers.
  • Incompatible controls.
  • Incorrect load.
  • Overheating.
  • Inadequate ventilation.
  • Installation inside insulation.
  • Use outside the stated voltage.
  • Use outside the stated IP rating.
  • Incorrect sealing.
  • Water ingress caused by installation.
  • Physical damage.
  • Impact.
  • Mishandling.
  • Unauthorised modification.
  • Opening or repair by an unauthorised person.
  • Incorrect storage.
  • Corrosion.
  • Chemical exposure.
  • Pest damage.
  • Fire.
  • Flooding.
  • Structural failure.
  • Normal wear and tear.
  • Failure of third-party wiring or automation systems.

A manufacturer-warranty exclusion does not exclude liability for a defect or loss for which Phoslume remains responsible under applicable law.

Warranty-Related Labour and Ancillary Costs

Unless expressly included in the manufacturer warranty, Phoslume quotation or applicable law, a Product warranty may not include:

  • Electrician charges.
  • Removal and reinstallation.
  • Ceiling opening.
  • Ceiling repair.
  • Joinery repair.
  • Painting.
  • Civil work.
  • Scaffolding.
  • Access equipment.
  • Transport to site.
  • Control-system programming.
  • Loss of use.
  • Project-delay costs.

Where the issue results from a separately contracted Phoslume installation or service deficiency, it will be assessed under Phoslume’s service obligations rather than treated solely as a manufacturer-warranty matter.

Phoslume’s Service Layer

Phoslume’s service layer may include:

  • Fixture-selection guidance.
  • Beam-angle guidance.
  • Glare-control guidance.
  • Colour-temperature guidance.
  • Driver recommendations.
  • Dimming recommendations.
  • BOQ preparation.
  • Procurement coordination.
  • Delivery coordination.
  • Installation notes.
  • Site coordination.
  • Aiming guidance.
  • Commissioning support.

Only Services expressly included in the accepted quotation are part of the order.

Phoslume will perform contracted Services with reasonable care and skill.

Phoslume’s service commitment is separate from the manufacturer’s Product warranty.

Service Limitations

Phoslume is not responsible for an error or outcome caused by:

  • Incomplete drawings.
  • Incorrect measurements.
  • Uncommunicated site changes.
  • Incorrect ceiling heights.
  • Furniture-layout changes.
  • Joinery changes.
  • Late-stage design changes.
  • Product substitution without approval.
  • Driver substitution.
  • Dimmer substitution.
  • Incorrect installation.
  • Failure to follow issued instructions.
  • Electrical conditions outside Phoslume’s scope.
  • Work performed by independent contractors.
  • Failure to provide access for inspection or correction.

Where a contracted Phoslume Service is materially deficient, Phoslume may:

  • Correct the affected document.
  • Revise the recommendation.
  • Repeat the affected Service.
  • Provide reasonable remedial assistance.
  • Offer another remedy required by the contract or applicable law.

Site Visits

A Product purchase does not automatically include a site visit.

Site visits are included only where:

  • Stated in the quotation.
  • Separately purchased.
  • Confirmed by Phoslume in writing.

The Customer must ensure that the site is:

  • Safe.
  • Accessible.
  • Ready for the agreed activity.
  • Supported by the required contractors.
  • Supplied with electricity where required.
  • Free from unreasonable obstruction.

Additional charges may apply for repeat visits caused by:

  • Incomplete work.
  • Absent contractors.
  • Lack of access.
  • Lack of electricity.
  • Changed site conditions.
  • Incorrect information.
  • Customer-requested rescheduling.

Aiming and Commissioning

Aiming and commissioning are separate from Product supply unless expressly included.

Commissioning may include:

  • Aiming adjustable fixtures.
  • Balancing visible light levels.
  • Basic scene guidance.
  • Identifying apparent installation issues.
  • Checking intended fixture orientation.

Commissioning does not include electrical certification, automation programming or rectification of third-party workmanship unless separately agreed.

The final lighting effect depends on the installation being complete and operational before commissioning.

Customer Responsibilities

The Customer is responsible for:

  1. Providing accurate billing and delivery information.
  2. Providing correct project drawings and dimensions.
  3. Reviewing the final quotation and BOQ.
  4. Obtaining approvals from the architect, designer, consultant and property owner.
  5. Confirming Product suitability before installation.
  6. Using qualified installers.
  7. Following Product and manufacturer instructions.
  8. Providing appropriate electrical protection.
  9. Storing Products safely.
  10. Inspecting Products before installation.
  11. Not installing visibly damaged or incorrect Products.
  12. Maintaining access to drivers and serviceable components.
  13. Retaining invoices and warranty documents.
  14. Informing Phoslume before changing approved Products or controls.

Product Storage and Handling

Before installation, Products must be stored:

  • In a dry location.
  • In their protective packaging.
  • Away from construction dust.
  • Away from water and chemicals.
  • Away from impact.
  • Within the manufacturer’s storage conditions.

Phoslume is not responsible for damage caused after delivery by incorrect storage, construction activity, water, dust, paint, plaster, chemicals or mishandling.

Promotions, Discount Codes and Offers

Promotions, discount codes and special offers:

  • Apply only during the stated period.
  • May be limited to specified Products.
  • May be limited to specified Customers.
  • Cannot ordinarily be combined.
  • Have no cash value.
  • May be subject to stock availability.

Material offer conditions will be displayed with the offer.

Phoslume may reject fraudulent use, duplication, manipulation or misuse of an offer.

Phoslume will not intentionally use false stock shortages, misleading countdowns or misleading price comparisons.

Website Availability and Accuracy

Phoslume will use reasonable efforts to keep the Website accurate and available.

However:

  • Products may become unavailable.
  • Prices may be updated.
  • Technical errors may occur.
  • Website access may be interrupted.
  • Content may be corrected.
  • Product pages may be revised.

Phoslume may correct an obvious error before dispatch and will inform the affected Customer.

Where the Customer does not accept a material correction, the affected order may be cancelled and refunded.

Intellectual Property

The Website and its original content—including the Phoslume name, identity, copy, layouts, graphics, lighting guides, photographs, videos, illustrations, diagrams, BOQ formats and service documentation—are owned by or licensed to Lusso Cassano Private Limited.

Customers may view and retain reasonable copies for:

  • Evaluating Products.
  • Purchasing Products.
  • Executing an approved project.
  • Coordinating an authorised installation.

Without written permission, you may not:

  • Republish substantial Website content.
  • Copy the Product catalogue.
  • Copy original Phoslume photography.
  • Use Phoslume content to sell competing Products.
  • Remove copyright or trademark notices.
  • Create a confusingly similar website.
  • Misrepresent yourself as Phoslume.
  • Claim an unauthorised dealership.
  • Create a competing Product database from Phoslume content.

Third-party manufacturer content remains subject to the rights of the relevant owner.

Project Drawings and Customer Materials

Drawings, plans, photographs and documents supplied by the Customer remain the property of their lawful owner.

By supplying them to Phoslume, the Customer confirms that Phoslume may use them for:

  • Quotation.
  • Product selection.
  • Lighting specification.
  • BOQ preparation.
  • Coordination.
  • Service delivery.
  • Internal project records.

Phoslume will not publicly publish identifiable project material without appropriate permission.

Automated Access, Crawlers and AI Systems

Phoslume may permit recognised search-engine and AI-search crawlers to access publicly available portions of the Website in accordance with applicable technical instructions.

Permission to crawl or index public pages for legitimate search discovery does not automatically grant permission to:

  • Circumvent access controls.
  • Ignore robots.txt instructions.
  • Scrape the Website at an unreasonable rate.
  • Copy the complete Product catalogue.
  • Replicate Product descriptions.
  • Monitor prices for competitive resale.
  • Build a substitute commercial database.
  • Use original Phoslume content to train a commercial generative-AI model.
  • Compile Phoslume content into a commercial training dataset.
  • Misrepresent Phoslume content as belonging to another party.

Phoslume may restrict automated access that threatens Website security, performance, intellectual property or legitimate commercial interests.

Nothing in this clause prevents lawful quotation, indexing, linking or use permitted by applicable law.

Reviews and Customer Content

Where a Customer submits a review, photograph, testimonial or other content, the Customer confirms that:

  • It reflects a genuine experience.
  • It is not knowingly false.
  • The Customer has the right to submit it.
  • It does not infringe another person’s rights.
  • It does not reveal confidential information.
  • It does not contain unlawful or abusive content.

Phoslume may moderate content for legality, relevance, privacy, spam and authenticity.

Phoslume will not knowingly alter a review in a way that misrepresents the Customer’s opinion.

Project photographs will not be used publicly without appropriate permission.

Third-Party Services

The Website and order process may use third parties including:

  • Shopify.
  • Payment gateways.
  • Banks.
  • Logistics companies.
  • Cloud providers.
  • Analytics providers.
  • Email services.
  • WhatsApp or communication platforms.
  • Manufacturer systems.

Third-party services may be subject to their own terms and privacy practices.

Phoslume remains responsible for its own obligations but cannot guarantee uninterrupted operation of an independent third-party system.

Marketing consent will not be treated as a condition for purchasing a Product unless the communication is necessary for that transaction.

You must not use the Website or Phoslume Services:

Phoslume may restrict access or cancel an affected transaction where misuse is reasonably suspected.

Customers must follow all safety, installation and maintenance instructions.

Products must not be:

  • Modified without approval.
  • Operated outside the stated voltage.
  • Installed in an unsuitable environment.
  • Used with incompatible components.
  • Covered with insulation where prohibited.
  • Installed without appropriate access or ventilation.
  • Used after visible damage.
  • Opened or repaired by an unauthorised person.

Where a Product appears unsafe, the Customer should stop using it and contact Phoslume.

Disclaimer

The Website is provided on an “as available” basis.

Phoslume does not guarantee that:

  • The Website will always be uninterrupted.
  • Every Product will remain in stock.
  • Every Product image will reproduce colour exactly.
  • General educational guidance will produce an identical result in every project.
  • Third-party services will always remain available.

Nothing in these Terms excludes responsibility for:

  • Fraud.
  • Wilful misconduct.
  • Gross negligence.
  • Defective Products where liability applies.
  • Deficient Services.
  • Personal injury caused by unlawful conduct.
  • Any obligation that cannot lawfully be excluded.

Limitation of Liability

To the maximum extent permitted by law, Phoslume will not be liable for indirect, incidental or consequential commercial losses arising from:

  • Incorrect installation.
  • Failure to verify specifications.
  • Use of incompatible third-party components.
  • Unauthorised modification.
  • Failure to follow instructions.
  • Delays outside Phoslume’s reasonable control.
  • Site work outside Phoslume’s contracted scope.
  • Decisions made using general educational content instead of project-specific advice.

For a Trade Customer, Phoslume’s aggregate contractual liability will ordinarily not exceed the amount paid for the affected Product or Service giving rise to the claim.

This limitation does not apply where:

  • Liability cannot lawfully be limited.
  • The loss results from fraud or wilful misconduct.
  • A greater remedy is required under applicable law.
  • A separately signed contract provides otherwise.

Nothing in this clause restricts a Consumer’s non-waivable rights.

Indemnity

To the extent permitted by law, the Customer agrees to indemnify Lusso Cassano Private Limited against third-party claims directly resulting from:

  • The Customer’s unlawful Website use.
  • False authority claimed when ordering for another party.
  • Unauthorised Product modification.
  • Misleading resale representations.
  • Infringement caused by content supplied by the Customer.
  • Material breach of these Terms.

This indemnity does not apply to loss caused by Phoslume’s own breach, negligence or unlawful conduct.

Force Majeure

Phoslume will not be liable for delay or failure caused by events beyond its reasonable control, including:

  • Natural disasters.
  • Flood.
  • Fire.
  • Severe weather.
  • War.
  • Civil disturbance.
  • Epidemic.
  • Pandemic.
  • Government restrictions.
  • Customs delay.
  • Port disruption.
  • Transport interruption.
  • Labour disruption.
  • Manufacturer shutdown.
  • Utility failure.
  • Network failure.
  • Supply-chain disruption.

Phoslume will use reasonable efforts to communicate material delays and resume performance.

Where performance becomes impossible for a prolonged period, the affected unperformed portion may be cancelled, subject to payment for completed Services and non-recoverable custom procurement costs lawfully incurred.

The internal grievance mechanism does not prevent a Consumer from approaching a competent consumer commission, statutory authority or other legally available forum.

Governing Law

These Terms are governed by the laws of India.

Subject to mandatory consumer-protection jurisdiction, courts and competent forums in Bengaluru, Karnataka will have jurisdiction over disputes connected with these Terms or a Phoslume transaction.

Nothing in this clause prevents a Consumer from approaching a consumer commission or statutory forum having jurisdiction under applicable law.

Good-Faith Resolution

Before commencing formal proceedings, the parties are encouraged to attempt good-faith resolution through:

  1. Customer Care.
  2. Escalation to the Grievance Officer.
  3. Written discussion between authorised representatives.
  4. Mediation or another mutually agreed resolution process.

This clause does not prevent urgent legal relief or restrict a statutory right.

Changes to These Terms

Phoslume may update these Terms to reflect changes in:

  • Law.
  • Regulation.
  • Products.
  • Services.
  • Website functionality.
  • Payment systems.
  • Shipping arrangements.
  • Business operations.
  • Security practices.

The updated Terms will display a revised “Last Updated” date.

A change will not retrospectively remove rights that arose under an already accepted order unless required by law or agreed by the parties.

Severability

If any provision of these Terms is held invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

The affected provision will be interpreted or modified only to the minimum extent necessary to make it valid and enforceable.

No Waiver

A delay or failure by Phoslume to enforce a right does not constitute a waiver of that right.

A waiver is effective only where confirmed in writing by an authorised representative.

Assignment

The Customer may not transfer contractual rights or obligations without Phoslume’s written consent, except where permitted by law.

Phoslume may transfer its rights and obligations as part of:

  • A corporate restructuring.
  • Business transfer.
  • Merger.
  • Group-company arrangement.
  • Sale of the relevant business.

Such transfer will not reduce the Customer’s existing rights.

Entire Agreement

These Terms, together with the accepted quotation, order confirmation, invoice, policies and Product-specific conditions, constitute the agreement governing the transaction.

A verbal statement will not alter the agreed specification, price or scope unless confirmed in writing by an authorised Phoslume representative.
